ESIC Salary Limit 2026 and Wage Eligibility

The ESI wage limit is ₹21,000 per month for most employees and ₹25,000 for employees with disability. Coverage also depends on whether the establishment and area are covered.

Current ESIC wage limit

Employee categoryMonthly wage limit
Most employees₹21,000
Employees with disability₹25,000
Confirm the latest ESIC notification before applying a threshold to payroll.

The limit is applied to wages as defined under the ESI Act, not merely basic salary. The wage components included for coverage and contribution should therefore be reviewed before an employee is excluded.

What happens when wages cross the limit?

ESI uses fixed contribution periods from April to September and October to March. If an employee's wages rise above the applicable limit after a contribution period begins, contribution generally continues until that period ends. Coverage is reviewed for the next contribution period.

Overtime is generally included for calculating contribution but is not treated in the same way when deciding initial coverage. Review the statutory wage definition for the employee's full pay structure.

Employer eligibility check

  1. 1Confirm that the factory or establishment is covered and located in a notified area.
  2. 2Apply the employee threshold relevant to the establishment and state.
  3. 3Calculate wages under the ESI Act definition.
  4. 4Check whether the employee was already covered at the start of the contribution period.
  5. 5Record the decision and contribution-period treatment in payroll files.

Frequently asked questions

What is the ESIC salary limit in 2026?
The limit is ₹21,000 per month for most employees and ₹25,000 for employees with disability, subject to current notifications.
Is ESIC based on basic salary or gross wages?
ESIC uses wages as defined by the ESI Act. It is not calculated on basic salary alone, and not every CTC component is necessarily included.
Does ESI stop immediately when salary exceeds ₹21,000?
Generally no. If wages cross the limit during a contribution period, contribution continues until that contribution period ends.
Is overtime counted for the ESIC limit?
Overtime is generally included for contribution calculation but treated differently when deciding whether the wage ceiling is crossed for coverage.
