How minimum wages are determined

• The appropriate government — Central or State — notifies rates for each scheduled employment.
• Rates differ by skill category: unskilled, semi-skilled, skilled and highly skilled.
• Many states also vary rates by zone or area classification.
• A variable dearness allowance component is revised periodically, commonly twice a year.

Rates change frequently. Always apply the notification in force for the relevant state, employment and period rather than a figure carried forward from an earlier payroll cycle.

Employer responsibilities

• Pay at least the notified minimum wage for the employment and skill category.
• Pay wages within the prescribed wage period without unauthorised deductions.
• Maintain the wage register, muster roll and wage slips.
• Display the notice of rates of wages at the workplace.
• Apply revised rates from the effective date of the notification, including arrears.

Consequences of underpayment

Underpayment can lead to a claim for the difference along with compensation, plus prosecution. In contract labour arrangements, the principal employer can be made to pay the shortfall if the contractor does not.
