ESIC Applicability and the ₹21,000 Wage Ceiling Explained

2026-05-05 · 7 min

ESIC coverage is one of the most misunderstood areas of Indian payroll. This article clarifies wage definitions, coverage thresholds and the implications of crossing or falling below the ₹21,000 ceiling mid-year.

Establishments covered

Factories with 10+ employees and most shops, hotels, restaurants, cinemas and educational institutions with 10+ (or 20+ in some states) employees fall within the ESI Act.

Wage components for ESI

Basic, DA, HRA, conveyance, overtime and most allowances form 'wages' for ESI. Annual bonus, gratuity and washing allowance are excluded.

What happens when wages cross ₹21,000?

Coverage continues till the end of the ongoing contribution period (April–September or October–March), and the employee exits ESI thereafter.
